Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, network identifier, or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Sources and Categories of Personal Data Processed

1. The Controller processes personal data that you have provided to the Controller or personal data that the Controller has obtained on the basis of fulfilling your order.

2. The Controller processes your identification and contact details and data necessary for the performance of the contract.

III.
Legal Basis and Purpose of Personal Data Processing

1. The legal basis for processing personal data is:

  • performance of a contract between you and the Controller pursuant to Article 6(1)(b) GDPR,
  • the Controller’s legitimate interest in providing direct marketing, in particular sending commercial communications and newsletters, pursuant to Article 6(1)(f) GDPR,
  • The purpose of processing personal data is to process your order and exercise the rights and obligations arising from the contractual relationship between you and the Controller. When placing an order, personal data necessary for successful processing of the order (name and address, contact details) are required. Providing personal data is a necessary requirement for concluding and performing the contract; without providing personal data, it is not possible to conclude the contract or for the Controller to perform it, send commercial communications, or carry out other marketing activities.

2. The Controller does not carry out automated individual decision-making within the meaning of Article 22 GDPR. You have given your explicit consent to such processing.

IV.
Data Retention Period

1. The Controller retains personal data:

  • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from those contractual relationships (for 15 years from the termination of the contractual relationship).
  • until consent to the processing of personal data for marketing purposes is withdrawn, for no longer than 5 years, if the personal data are processed on the basis of consent.

2. After the personal data retention period expires, the Controller will delete the personal data.

V.
Recipients of Personal Data (Controller’s Subcontractors)

1. The recipients of personal data are persons:

  • involved in the delivery of goods / services / execution of payments under the contract,
  • providing services related to the operation of the jvprofi.cz website,
  • providing marketing services.

2. The Controller does not intend to transfer personal data to a third country (a country outside the EU) or to an international organisation.

VI.
Your Rights

1. Under the conditions set out in the GDPR, you have:

  • the right of access to your personal data pursuant to Article 15 GDPR,
  • the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,
  • the right to erasure of personal data pursuant to Article 17 GDPR,
  • the right to object to processing pursuant to Article 21 GDPR,
  • the right to data portability pursuant to Article 20 GDPR,
  • the right to withdraw consent to processing in writing or electronically at the address or email address of the Controller stated in Article III of this Policy.

2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VII.
Personal Data Security Conditions

1. The Controller declares that it has adopted all appropriate technical and organisational measures to secure personal data.

2. The Controller has adopted technical measures to secure data repositories and repositories of personal data in paper form, in particular by storing data in a secure password-protected repository, using antivirus data protection, and keeping paper documents in a secure location (a lockable box).

3. The Controller declares that only persons authorised by the Controller have access to personal data.

Final Provisions

1. By submitting an order from the online order form, you confirm that you have read the terms of personal data protection and accept them in full.

3. The Controller is entitled to amend this Policy. The new version of the Privacy Policy will be published on the Controller’s website, or the Controller may send the new version of this Policy to the email address you provided to the Controller.

This Policy takes effect on 1 November 2023.
